So now that California residents are more and more becoming disarmed, the state feels emboldened to pass laws that redefine what it takes to toss you into a camp. The latest is a law that enables authorities to toss you in a camp if they feel that you can’t properly care for yourself.

state law allows courts to order people into treatment, but only if they are “a danger to themselves or others.” This new proposal would expand that definition to include people who, because of a mental illness or an addiction to illegal drugs, are not capable of caring for themselves or protecting their own safety.

They redefined mental illness to say that men who think they are women so completely that they have someone cut off their dick are completely rational and should be a protected class. How long before they redefine a belief in liberty or the RKBA to be a mental illness?

The law is not what you think. If you have ever been in California and wondered why there were so many mentally ill on the streets it because the ACLU bough a court case in 1987 (Reise v St Marys) that gave the severe menially ill the “right” to reject all medication.

Every attempt since then to bring in sane and humane guardianship etc laws to make sure the seriously mentally ill received the medication they need to keep them functional and off the streets has be blocked in the courts by “patient rights” groups like Disability Rights CA and the ACLU. All that was left is the totally ineffectual short term 5150 hold.

These “rights” groups are responsible for the deaths of many thousands of mentally ill on the streets. People who with medication would still be alive today. These are not the street junkies. Who almost all ended up on the streets through their own agency and very bad personal decisions.

As for trannies. Seriously mentally ill and at least for the male ones, usually some form of psychopath in my experience. As for why its now a big deal thats easy – money. The Gay Lobbyist industry needed a new fund raising cause after all the other cause were “successful” so trannies was all that was left. In cities like SF its a $10’s million p.a business.

Follow the money.

I’m sure you can see how this law can be abused. Since it’s California, it’s a guarantee that it will be.

Very familiar with the utter insanity of California courts. I’ve got stories that never made it out of state. But having watched very serious mentally ill live and die on the streets for decades and seen the despair of families who cannot do for their seriously mentally ill family members in California what they could easily do in WA, NV or even OR to make sure their family members gets long term supervised medication that law is only a small step in the right direction.

I have seen seriously mentally ill people have psychotic episodes on the street due to not taking their medication. Even in a city like Seattle you can call 911 knowing that the person having the episode will not only be stabilized but can given long term help. Because the legal framework is there.

But in a city like SF or anywhere else in CA there is literally nothing that can be done for these poor people. The SFFD paramedics can stabilize the condition of the person having the episode but even if a 5150 hold can be got, which is very difficult, the once stabilized mentally ill person is soon on the streets again. Because they dont keep taking their meds.

After what I have seen over the years I consider people like the ACLU and Disability Rights California as utterly evil. Truly evil people. DRC is a bunch of very highly paid “civil rights” lawyers who get $50M p.a of state money to bring mostly frivolous lawsuits. Which put and then kept the mentally ill on the streets for the last 5 decades. DRC have already filed yet another frivolous lawsuit against the law you mention.

So yeah. That law is a good thing. A very good thing. Despite the potential for abuse. Of course it would be better if we got the original Lanterman–Petris–Short law back. Or something like it. But the “activists” will try to stop this no matter what. Evil evil people.

I’ll spare you the bandwidth and/or heartburn, and reply in depth at my place.

TL;DR: I don’t think you could be farther off the mark here.
Your response to any degree you choose is welcomed and appreciated.

For whatever it’s worth,

I can certainly see both sides of the argument. On one hand, we have a government bodies throughout the western world that have demonstrably shown that they cannot be trusted, either due to malice or sheer incompetence. Based on that, I too would not be inclined to grant them the kind of power to arbitrarily arrest and detain anyone, especially for such broad and vague reasons.

On the other hand, although I haven’t been to California in several years, I have spent A LOT of time working on skid row due to my career. Because of that, the vast majority of my career has been spent dealing with all sorts of shenanigans the people that Aesop and tfourier have mentioned. Dealing with transient populations is not fun at all and it is a problem that has been allowed to fester for far too long.

That all having been said, this raises some questions. Notably, what kind of facilities or camps will these people be put into? What kind of ‘treatment’ are these people going to receive? And most importantly, as Divemedic pointed out, what exactly is the legal standard for arresting and detaining someone and is it clearly defined, so as not to be abused?

Knowing government as I do, I can’t help but wonder if this is going to be just another ‘band-aid’ solution which might end up doing more harm than good in the long run because the people that implemented it were incompetent or didn’t give a damn.

Homeless, drug addled bums are a huge problem. I certainly agree that there needs to be an answer. I just don’t think that more government power is the answer. It rarely is.

    JL · March 4, 2023 at 2:44 pm

I quite agree, Divemedic. We don’t need MORE government, especially since it was the attitude of government that created this problem in the first place. Not only that, but I am VERY averse to changing the way the state does business and giving government of any kind sweeping arbitrary powers for any reason. Today, we are using them on people we do not like. Tomorrow, they could be used on us.

My solution? Sour the milk. The reason these people flock to the streets of California, or any left wing city for that matter, is because it’s easy for them to be there. These governments have essentially incentivized being transient simply by refusing to crack down on their behavior.

So…..maybe if they STOP defunding their police and have them actively and aggressively enforce the laws already on the books, as well as have the courts actually prosecute these people instead of paying these problems lip service at best, that’d be a start.

While some of these people are on legitimate hard times, many of them need a solid kick in the ass.

    Not that TPTB would listen.
