Open carry is illegal in Florida, with certain exceptions. Any ideas?

Possible LEO.

The pants and Serpa holster scream security guard\mall ninja, but that is a really nice bike. No cop would or should carry in that POS holster, especially on a bike. Maybe prison guard or something like that, but I doubt that is SOP\regulation open carry either…so my best bet is on “Florida man” who has a bit more money and is breaking the law.

    Divemedic · August 21, 2023 at 6:54 pm

My guess is security guard. That bike is a BMW R1250, and they sell for about $20k. Or he is illegally carrying because he thinks the recent change to Florida law allows it.

All things considered (Serpa, overall look and “vibe”), there’s a good chance this guy has a “Concealed Carry Permit Badge” like they sell at gun shows and he thinks that makes him ok. Wearing a Serpa is consistent with this kind of thinking.

been using my old serpa for a couple months now… they aren’t as bad as everyone thinks…no part of the holster touches the trigger… knock on wood, been carrying a gun on my hip so long I think it’s instinct not to go near the trigger until I’m ready to fire…

      Divemedic · August 21, 2023 at 8:51 pm

I have a Serpa that I use for the range. Why? I can’t OC and don’t see a point in paying for a more expensive holster that I can’t use anywhere else.

        C · August 22, 2023 at 11:42 am

I feel the same way about Serpa holsters, but there are better options.

Well, there’s this per the Polk County sheriff (not sure if it’s correct or not, or how broadly the “traveling” exception can be applied):

https://www.polksheriff.org/news-investigations/2023/06/30/florida-s-new-permitless-concealed-weapon-carry-law-begins-july-1
“Open carry is still against the law in Florida (with exceptions where you are actively fishing, camping, hunting, or target shooting, or traveling to or from these activities).”

Tom from East Tennessee · August 21, 2023 at 8:25 pm

If the bike rider is aware of the law, he would probably argue one of these. However it is you argue that you’re on the way to the range, or fishing, or whatever.
I think it’s more likely the situation is one of the other comments, such as mall ninja, prison guard, security guard or someone who misread a news story and thinks he’s legal OCing.

Florida Carry Protest, using the hunting / fishing exception? =)

Big Country Expat · August 21, 2023 at 6:53 pm

When I worked for Critical Intervention Services, according to “Da Roolz” we could carry like that back and forth from and to work. The holster looks like a two stage retention (Cop Holster) and that might be the case here

    Vlad · August 22, 2023 at 4:05 am

Sorry BCE, that’s a plain ol’ Serpa that many schools have banned from use.
They can get dirt, mud etc., under the lever rendering them unable to release the gun AND you have to trigger finger bang it to get it to release. Using you trigger finger to release the gun invites the finger to be active with bad results when a loaded gun is involved.
There are plenty of other holsters that provide retention and none of them require the trigger finger to do anything.

Big Country Expat · August 22, 2023 at 12:11 pm

Thanks Vlad. I know ALL the weapons, but holsters and whatnot, outside of Blackhawk and some others that I personally use, notsomucho. Appreciate the info!

Pretty sad when the “gunshine” state is decades behind Indiana in gun laws….

    Scotty · August 23, 2023 at 6:01 am

    It’s a little more complicated.

Before 1987, we had permitless open carry in the state. When the state legislature passed out concealed carry statute, they did a dishonest degree of trading or horse flesh: nixed open carry. Now we have at least two or three generations of gun owners with no memory of open carry being legal, and many of whom pull that fudd bullshit about it being useless (they’ll shoot you first!) or whatever; instead of understanding there are many states where you can just do it and nobody gives a fuck, it’s just a thing regular people do.

Pants have a strong LEO vibe, but US Navy sailors wear those on the flight deck of carriers, so it isn’t a certain thing. I doubt that is a federal LEO, as Blackhawk Serpa is banned at FLETC, and has been for years. Whoever it is, they need to learn about how unsafe that holster is, it is a piece of junk.

    Divemedic · August 21, 2023 at 8:26 pm

So the Navy finally got rid of those stupid, ugly dungarees?

      Unknownsailor · August 21, 2023 at 11:53 pm

Dungs were replaced by utilities in 2000.

Utilities were replaced by Navy Working Uniform Type II (blue cammies) in 2009.

NWUs were replaced by NWU Type III (green cammies) in 2019 because the blue ones were flammable.

I retired wearing blue cammies in 2014. I was a three time uniform change victim, three time rating merger victim. AK -> SK -> LS (merger of postal clerk and SK) Postal Clerk is now basically a NEC for LS.

A little discordant.

Depending on the model, that’s a $650-1000 helmet. Decent riding jacket, but the gloves look cheap – the carbon-fibery knuckle guards and bulkiness on the fingers.

Sneakers – so no ankle protection nor extra stability. And the bike has no luggage nor do I see mount points for same – very strange for a BMW.

So … Fed. 🙂

Boneman · August 22, 2023 at 5:03 am

That’s an interesting photo overall. First… and I’m a former rider… that much BLACK in our current Florida HEAT is just begging for heat stroke… Second, would it be possible to effectively use that firearm with those gloves? Color me dubious. I think most comments have covered the possible reasons / excuses as to how one _gets away with_ this open carry situation. I have to question why one is compelled. That can be answered by looking at some of the insane videos of road ragers vs. motorcycists.

Still…. it’s not something I would do unless I were L.E., in my own jurisdiction where anyone on duty would recognize me and not pull me over in a heartbeat if they saw this.

Riddle · August 22, 2023 at 8:23 am

Dude is a poseur. $20,000 bike that, looking at the wear marks on that rear tire, has never once been ridden through a corner at speed. Fully 1 1/2 inch wide “Chicken Strips” that have never seen asphalt in anger. Totally acceptable if it was a Hardly-Ableson, but that is a finely tuned racing machine. At least he’s got the good since to wear proper gear, that Shoei helmet costs $6-800, if you’ve got a $10 head, wear a $10 helmet!

    EN2 SS · August 22, 2023 at 2:09 pm

Yep, a lot of people use bikes as transportation or to look good, but few RIDE bikes, of any kind.

Newly hired IRS agent on his way to the range for training?

Danny · August 22, 2023 at 9:30 am

Isn’t that ol’ Bubba Justice – the sheriff’s nephew? I think he works over there at Billy Bob’s Guns Jewelry and Pawn.

TRX · August 22, 2023 at 10:21 am

“Oops, I meant to put my Taser on, but I got the Glock instead. Sorry about that.”

Works for cops when they “accidentally” shoot someone instead of Tasering them, anyway.

The New Civility · August 22, 2023 at 11:10 pm

The local outlaw biker leader open carried years before Constitutional carry due to a shoot on sight order from a rival gang.
It does feel good living in an open carry state due to the increase in civility.
The transplant termite copsuckers are working on it though with delusions of protect and serve donut molesters swooping in just in time.
A box wine auntie who just loves the CPUSA is worried about a smashed out garage window as the voting consequences come home to roost.
I might take a trombone over and play a sad song just to help out.

J78133 · August 23, 2023 at 1:50 pm

It’s an S1000R bike (“hyper naked”). I carry on my bike in an El Paso Saddlery Tanker holster under my jacket. Open carrying like that on a bike isn’t a good idea for many reasons IMHO
