The Hawaii Supreme Court has ruled that SCOTUS was wrong in the decisions in Bruen and in Heller. For that reason, they have ruled that a man can be prosecuted for rights protected by the Constitution, and have reinstated his case.

I am not interested in litigating the case here. I am interested in pointing out that the states are increasingly ignoring the decisions of the Federal courts. This can only end in one place- the complete collapse of the system of government of the US.

First, realize I am an old fart that was schooled back in the fifties before anything was woke. I was taught that the design of our government was such that no branch (Legislative, Executive, Judicial) was higher than the other, but all were equal. If the Supreme Court (Judicial) can dictate what is or isn’t allowed, then that branch is above the other two. It also means we are being ruled by the one branch of government that is NOT elected. I do foresee the imminent collapse of our government, but it is not from a gun issue in Hawaii.

    The way that it’s supposed to work, if they were equal:
    Legislative makes laws. The also provide funding to the other two branches.
    Executive carries out laws.
    Judicial determines if whether or not those laws and the acts taken to enforce them are Constitutional. (Marbury v Madison, from long before you were born)
    The balance to all of these was the states, whose powers were gutted by Lincoln and the civil war, in concert with the 16th and 17th Amendments.

      We all know the Constitution is a farce now anyway. The 4th protects us from search/seizure by the gov’t (except in cases of drug suspicion /dui checkpoints / or entering government facilities). The 2nd protects our right of firearm possession (unless the firearms are scary looking like an assault rifle or your shotgun is too short). The 1st protects our right of speech, worship and assembly (unless there is a flu going around, then you can’t worship or assemble). The 5th protects you from forced self incrimination but they can subpoena your cell phone records and automobile computers to determine your culpability. I could go on, but you get the picture. I guess it’s why they don’t teach it in school anymore.

Completely agree with your assessment. Add to that situation the fact that the Biden administration openly gives the middle finger to the Constitution and SCOTUS. They knowingly violate the Constitution figuring it will take years before the court system slaps them down (e.g. the student loan debt forgiveness and the CDC’s covid eviction moratorium), and in the meantime they get whatever progressive policy in place and a certain amount of damage done before it is stopped.

I’d say collapse of the federal system, to be followed on by collapse of many state govts due to gross fiscal mismanagement (among other failings) is a foregone conclusion, given what is presently taking place. What comes out of that remains to be seen, but one can gather much chaos and violence will result. Maybe not nationwide, but the large urban centers are fucked once the wheels well and truly fall off the clown car.

And really, collapse needs to happen. Not only does most govt need to be wiped out so as to zero it’s voracious and insatiable appetite for stealing the productivity of the citizens to piss down endless rat holes, and end its abuse of the authority it has improperly granted itself, it also needs to go to ensure the propping up of the unfit and discivic will end, and in turn the scum of society and all the teat suckers will either die off, or get their ass in gear and become productive.

Incidentally, nullification has been going on a long time with BS like sanctuary cities. The number of instances of it has certainly picked up steam in the last few years, admittedly. It becomes easier as the fedgov becomes less competent and more self evidently fucked up. Now that it’s ability to project force is badly compromised (lawfare notwithstanding), some polities are beginning to notice the emperor is actually naked. This has brought about a mindset where the feds can now be openly challenged with some degree of confidence. Expect to see more of that going forward.

Pretty much every gun decision and every other high court decision that made any sense and was made is accordance to that former known as the Constitution document handed down by SCOTUS has been ignored and the court battle start all over again. Until the SCOTUS order the arrest of the offending parties for their repeated giant FU’s then nothing will change.

This can also end in the arrest, trial, and federal imprisonment of the entire Hawaiian Supreme Court, and any state court or officials, up to and including the governor, for depriving any citizen of his/her Constitutional rights under color of authority.

The penalty for that under federal law (18 USC 242) is anything up to LWOP, or even death, depending on the degree of offense, and the injury to the victim(s).
Hawaii is playing with fire in a wading pool filled with gasoline.

The state can also be declared “in rebellion”, have its statehood revoked, and a governor appointed over the territory. Given the strategic importance of Pearl Harbor, and the associated bases, 50:50 that would be a military governor, and martial law would be declared initially.

Which would also, incidentally, unseat Hawaii’s congressional delegation, including both senators, which flips the Senate to the (R)s.

NTTAWWT.

Challenge accepted: 27 states decide to start picking, cafeteria-style, which SCOTUS decisions they won’t follow either.
The first choice will be to ignore the 16th Amendment, and then it starts getting really interesting.

Probably spelled incorrectly, Latin not being my native language… Wasn’t President Jackson the first President to openly ignore a Supreme Court ruling he disagreed with? Sure, they can declare the law unconstitutional, but lack an enforcement mechanism… So, nothing new and while it is not SUPPOSED to happen, who is really surprised that it is happening? Why I left IL for TX, at least here there is a chance of things working in the long term. Illinois is lost. But YMMV, just my opinion…

Liberal state governments aligning with a liberal federal government/deep state against the constitution is just another fault line in which to fracture the country. Once all the illegals start voting, we’ll see this get worse because then Dems will have power in perpetuity.

This system of government only works if everyone agrees to play by the same set of rules…..that ain’t happening anymore. We’re getting pretty close to the point of no return. I’d expect to see more examples like we have with Texas, but with other red states over a range of issues not just immigration. If that keeps going, well then you are moving towards a divorce.

One difference here – this isn’t a case of a State gov’t flipping off the SC, as in Texas.. This is a State COURT doing so. Much different optics from the viewpoint of the legal-industrial complex.

Worth remembering that the Supreme Court is the only one established by (even mentioned in) the Constitution. ALL others are “as the Congress shall from time to time establish”.
