He can’t do this by executive action; it would require Congress changing (expanding) law… Of course, that doesn’t mean he won’t try to do it unilaterally…

    I see one way that he could. All he has to do is have the ATF technology branch declare that semi auto rifles are “readily convertible” to full auto, which make them functionally the same as machine guns.

      The registry for machine guns closed in 1986… the Secretary would have to use his previously unused authority to issue exceptions on a wide basis, enough to make a mockery of the system – and, it would authorize millions of new machine guns.
      I think they’d be more likely to pass legislation to add a semi auto/ large capacity magazine item to the NFA. But with that can of worms opened up, unexpected things could happen… Don’t forget that the Democrats have a majority of only 2 in the Senate and 5 in the House, several of which have left for new positions in this administration – it wouldn’t take many defections to throttle legislative action.
