(B) A PERSON WHO WAS UNDER THE AGE OF 25 YEARS AT THE TIME OF THE OFFENSE MAY NOT BE FOUND TO HAVE COMMITTED MURDER IN THE FIRST DEGREE UNDER SUBSECTION (A)(4) OF THIS SECTION.

OK, so what does subsection (A)(4) say?

(4) SUBJECT TO SUBSECTION (B) OF THIS SECTION, committed in the perpetration of or an attempt to perpetrate:
(i) arson in the first degree;
(ii) burning a barn, stable, tobacco house, warehouse, or other outbuilding that:
1. is not parcel to a dwelling; and
2. contains cattle, goods, wares, merchandise, horses, grain, hay, or tobacco;
(iii) burglary in the first, second, or third degree;
(iv) carjacking or armed carjacking;
(v) escape in the first degree from a State correctional facility or a local correctional facility;
(vi) kidnapping under § 3–502 or § 3–503(a)(2) of this article;
(vii) mayhem;
(viii) rape;
(ix) robbery under § 3–402 or § 3–403 of this article;
(x) sexual offense in the first or second degree;
(xi) sodomy as that crime existed before October 1, 2020; or
(xii) a violation of § 4–503 of this article concerning destructive devices.

If this passes, I am going to have to add Maryland to the “no go” zones list.

Cant have a huge swath of their likely voting demographic labeled a felon and unable to vote, not that voting matters..

Because most murders in Maryland are committed by blacks under 25.

Hmmm…IIRC, the 14th Amendment contains the language “No state shall make or enforce any law which shall abridge the privilege or immunities of the citizens of the United States;”

So, if someone under the age of 25 is absolved of first degree murder, sounds like it’s time for a >25-year-old to sue for equal treatment under the 14th Amendment.

I’m no legal beagle, but if what I am reading here I interpret correctly, they are saying anyone under the age of 25 (largest pool of offenders), cannot be convicted of 1st degree murder (planned, premeditated), if said murder occurs while they are carjacking someone or burning something down that isn’t a house.
Baffling on so many levels…. are they arguing a “youth” of 24 couldn’t possibly understand that their decision to carjack someone or burn a building down, could also result in the loss of life at their hands, thus manslaughter is the best you’ll get?
HAS to do with sentencing guidlines… a run around some other law that is tough on murder?

No conceal-carry in MD, either. And if you did defend yourself, you’d likely do more time than the criminal who threatened your life.

    First point is not ENTIRELY true, due to the recent SCOTUS Bruen decision. They make it difficult though, and time consuming. A recent HCP (handgun carry permit) class in January expects their students to be either denied (due to investigation issues), or receive their permits – probably by April. Maybe. Also – far too many places are ‘prohibited’ from carrying in, and if the (D) legislators have their way, nearly *everywhere* outside your home will be a ‘sensitive area’, where you are not allowed to carry. Legally. But hey, at least their voter demographic will be safer!

    As to your second point – that is unfortunately entirely likely.

They can be overzealous and get away with it.

I mean…who do you think will provide you better and more loyal service? A government gang in blue, or an ordinary gang?
