On the same day that Charlie Kirk was murdered, an important court decision went virtually unnoticed because of that event. Florida’s state courts have ruled that the state’s blanket ban on open carry is unconstitutional under Florida’s Constitution. The state has announced that they will not appeal. This means that the ruling will become the law of the land on September 25, assuming that the state doesn’t, in fact, file an appeal. The Sherriff’s of Brevard, Flagler, and Marion counties have already said that they will no longer enforce that law. Remember that private property owners can still ask you to leave the property if you are open carrying.

I find it hysterical that it took the Gunshine state losing a court case for ya’ll to get the same right Hoosiers have had for more than 40 years….

    Our sheriffs were and still are opposed to open carry. I have posted on that before.

Interesting … as I’ve understood the law for a number of years, in Florida you can open carry if you’re hunting, fishing or on the way to or from a shooting range. So if you’re down by the lake with a fishing rod …

I hope legal open carry is returned to the citizens of Florida. I remember bikers with shotguns in scabbards many years ago. And gun racks in the back window of the pickup with a couple of rifles on display. (I’ve been a resident of the state my whole life)

I am afraid the sheriff’s will just come up with some other infraction to harass gun owners with. The brandishing charge being used to harass concealed carry for long time. ( I know concealed means concealed but…)

I have never understood the desire to open carry a defensive gun. By doing that you ID yourself as armed and become a target. The Las Vegas shooting years ago where a civilian took on a robbery. He was shot from behind by female who saw him carrying and heading toward robber so she shot him in the back and he never saw it coming. Me personalty, I want to see the surprise on some guys face when he forces me to show him my favorite boom toy…
Besides there is the issue of how secure that weapon is in your holster, you will have scum who see you and decide to take that weapon. Some of the folks I see around here open carrying are older and or not really in physical shape to fight for a weapon. Few of the OC folks are using a level 2 or 3 holsters either. That’s just asking for problems. A what if is what if they grab your weapon and start shooting at everyone. YOU just became liable for the shooting, no one thinks about that.
